PDEstimates — Terms of Service

1. Acceptance of these terms

By creating an account or using PDEstimates ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use the Service.

2. What the Service does

PDEstimates generates construction and renovation cost estimates using AI (large language model technology), based on the job description, trade, region, and any photos you provide. The Service also lets you edit, export, and send these estimates to your own clients.

3. AI-generated content — read this carefully

Estimates produced by the Service are generated by artificial intelligence based on general knowledge and are provided for informational and planning purposes only. They are not guaranteed to be accurate, complete, or current, and do not account for site-specific conditions the AI cannot directly observe, local code requirements that may have changed, or supplier pricing at the moment you generate the estimate.

You are solely responsible for reviewing, verifying, and adjusting any estimate before presenting it to a client or relying on it for a bid, contract, or purchasing decision. The Service does not provide professional engineering, architectural, legal, or accounting advice, and nothing generated by the Service should be treated as such.

4. Your account and responsibilities

You're responsible for the accuracy of information you provide, for keeping your login credentials secure, and for all activity under your account. You agree to use the Service only for lawful purposes and only to generate estimates for genuine construction/renovation work.

You are solely responsible for any quote, estimate, or proposal you send to your own clients using content generated through the Service, including its accuracy, compliance with applicable building codes and permitting requirements, and any contractual or professional obligations that result from sending it.

5. Subscriptions and billing

Paid plans (Lite, Pro) are billed on a recurring monthly basis via Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. You can cancel any time from your account's billing portal; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for unused time unless required by law.

Prices and included usage (number of estimates, features per tier) may change with notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.

6. Limitation of liability

To the maximum extent permitted by law, PDEstimates and its owner/operator are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost business, or costs arising from inaccurate estimates, whether provided to you or to your own clients.

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless PDEstimates and its owner/operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) any estimate, quote, or proposal you send to a third party based on content from the Service, or (c) your violation of these terms.

8. Data and privacy

Our collection and use of your information is described in our Privacy Policy, which forms part of these terms.

9. Intellectual property

The Service, its software, and branding are owned by PDEstimates. Estimates you generate using your own project descriptions are yours to use freely in your business.

10. Termination

We may suspend or terminate your account for violation of these terms, non-payment, or abuse of the Service. You may stop using the Service and cancel your subscription at any time.

11. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
